Fee . . .

Our Retainer Fee is based upon a percentage of the selected candidate's first-year income. The estimated first-year income will be established at the onset of the search. Upon completion of the search, if the actual first-year income is greater than what was estimated at the onset of the search, the fee would be adjusted upward accordingly.

The Retainer Agreement applies to a specifically defined search assignment and is not transferable to other positions. The minimum fee is due regardless of the method in which the search is completed or in the event your firm decides to cancel the search—not making any hire. All fees remitted to Craig Lindell & Associates, LLC are non-refundable.

Terms of payment . . .

The fee is divided in thirds: first third up front, second payment at 30 days, and third payment at 60 days or upon completion, whichever comes first. Any and all legal fees or court costs incurred by Craig Lindell & Associates, LLC in an effort to collect an unpaid search fee shall be borne by the company owing the search fee.

Any other payment terms must be agreed upon in writing and approved by the President of Craig Lindell & Associates, LLC. Should any candidate be hired by an employer within two years of the last interview, the employer shall be responsible for payment of the placement fee to Craig Lindell & Associates, LLC.

Our Agreements are construed pursuant to the Laws of the State of Minnesota. Jurisdiction and venue for any claim arising our of the agreement shall be made in the State of Minnesota, County of Hennepin.

Referrals . . .

Further, in the event a candidate referred by Craig Lindell & Associates, LLC provides the Employer with additional names of others, or refers others to the Employer, these individuals shall also be considered as referrals of Craig Lindell & Associates, LLC. Should the Employer hire an individual referred by Craig Lindell & Associates, LLC for any other position, Craig Lindell & Associates, LLC will be entitled to its fee.
